Terms and Conditions of Booking

The Tour Company

By registering and making payment for travel, Us as travellers confirm acceptance of the following
Terms and Conditions of Travel. Please read these carefully, as they form a binding agreement
between the traveller and The Tour Company.

1. Booking Confirmation & Acceptance

  • All bookings are subject to final payment in full.
  • Registration and payment constitute full acceptance of these Terms and Conditions on behalf of all persons in the booking.

2. Deposits & Non-Refundable Payments

  • All deposits and subsequent payments are non-refundable.
  • Refunds apply only where covered by approved travel insurance or as expressly stated under the Cancellations & Refunds section.

3. Authority of the Lead Traveller

  • The principal person named on the booking confirms they have authority to accept arrangements and conditions on behalf of all travellers.
  • The principal traveller is responsible for:
  • Collecting payments and documentation
  • Checking booking arrangements
  • Confirming all travellers are fit to travel and able to participate unaided

4. Payment Schedules & Late Payment

  • Interim, instalment, and final payments must be made by the specified due dates.
  • Late payment may result in:
  • $100 administration fee
  • Automatic cancellation
  • Loss of deposits
  • Penalty interest

Final payment is due on demand or no later than 135 days prior to departure, whichever is earlier.

5. Itinerary Changes & Force Majeure

While brochures, websites, and itineraries are accurate at the time of publication, changes may occur
due to availability or local conditions.

The Tour Company reserves the right to vary itineraries, accommodation, attractions, transport,
schedules, or pricing where required.

Force Majeure

  • War, terrorism, civil unrest
  • Natural disasters or weather events
  • Epidemics or pandemics
  • Industrial disputes
  • Transport, supplier, or technical failures

No compensation is payable in such circumstances. Alternative arrangements, where available,
will be deemed full settlement of any claim.

6. Tour Hosts, Guides & Minimum Numbers

  • Tour hosts or guides may vary from those advertised.
  • Guided tours are subject to minimum group numbers being met.

7. Minimum Numbers for Group Travel

  • All tours and packages are subject to minimum participation numbers.
  • The Tour Company reserves the right to cancel tours that do not meet these requirements.

8. Currency Fluctuations

Due to payments made in foreign currencies, The Tour Company reserves the right to adjust tour pricing
or cancel a tour if the NZD or AUD significantly weakens against destination currencies.

9. Cancellations, Amendments & Refund Policy

Cancellation Fees

  • 121 days or more prior to departure: 50% non-refundable
  • 61–120 days prior to departure: 75% non-refundable
  • Within 60 days of departure: no refund
  • Supplier penalties apply from the time of booking.
  • Airfares, event tickets, insurance, visas, and taxes are non-refundable.
  • Amendments incur a $250 fee per change plus supplier charges.
  • No refund is available for unused services once documentation is issued.

10. Travel Insurance Requirements

Comprehensive travel insurance is mandatory for the full duration of travel.

  • Medical cover
  • Cancellation and deposit loss cover

Where insurance is not purchased through The Tour Company, a letter of indemnity is required
and a $100 claim assistance fee per person applies.

Loss of Deposit Insurance (Optional)

  • Cost: $95
  • Covers deposits up to $800
  • Valid for 28 days from registration or until next payment, whichever occurs first

11. Traveller Responsibilities

  • Monitor official travel advisories
  • Obtain medical advice and vaccinations
  • Ensure passport validity and required visas
  • Confirm fitness to undertake activities without assistance

12. Attractions, Events & Conditions Beyond Control

Attraction access and event timing are subject to availability, seasonal conditions, weather,
local closures, and circumstances beyond our control.

13. Travel Documentation

Final travel documents are normally issued approximately 10 days prior to departure.

14. Accommodation & Twin Share Policy

  • Twin share allocation is at the supplier’s discretion.
  • Requests for single accommodation after booking incur additional costs and booking fees.

15. Luggage Allowances

  • One wheeled suitcase per person
  • Maximum 20kg or airline allowance (whichever is lower)
  • Luggage must be manageable without assistance

16. Role of The Tour Company

The Tour Company acts as a travel arranger and booking agent, coordinating travel services,
accommodation, activities, and issuing tickets and vouchers.

17. Third-Party Suppliers & Liability

All services are provided by independent suppliers and are subject to their terms, conditions,
and local laws. Claims must be directed to the relevant service provider.

18. Exclusions from Tour Price

  • Gratuities
  • Local or bed taxes
  • Discretionary expenses
  • Meals or services not listed in the final itinerary

19. Complaints & Claims Procedure

Any issues must be raised immediately with the tour host or representative to allow reasonable
opportunity for resolution.

Written complaints must be submitted to The Tour Company within 7 days of the issue arising.
Failure to report issues promptly may invalidate subsequent claims.
